This Privacy Policy describes how ESA collects and uses personal data.
1. SCOPE
This Privacy Policy describes the treatment of information collected by ESA from natural persons and applies to all ways we collect information. Including ESA websites, ESA Apps, online account portals, email, text or other electronic communications, offline communications, in-person, mail, telephone, or third-party apps, and software that may assist in your recruitment and employment, such as TempWorks, Facebook, or Indeed.
ESA follows this Privacy Policy in accordance with the laws where we operate. By continuing to provide your personal information to ESA, including through our website, you are accepting the terms of ESA's data practices as detailed in this Privacy Policy.
Please remember that when you provide information to us on a third-party site or platform (for example, via separate job application websites), the information you provide may be separately collected by the third-party site or platform. Only the information we collect is covered by this Privacy Policy. The information a third-party site or platform collects is subject to the third-party site or platform's privacy practices. Privacy choices you have made on the third-party site or platform will not apply to our use of the information we have collected directly. 2. HOW WE COLLECT INFORMATION
We collect personal information directly from you when you apply for a job with ESA or one of our clients, respond to a posting, supply information for your benefit elections and human resource administration, or in the context of your employment with us. We also collect the information you provide when you make an account with us, sign up for communications with us, and during communications between us. We may also acquire your personal information from third-party sources, including through running background, consumer, and employment eligibility verification checks and from information provided by references you listed on your job application and publicly available sources of information. We also indirectly and passively collect information provided by your web browser when you visit our websites and applications. ESA or a service provider that operates the Services or any features therein collects, stores, and processes information automatically collected when you use or access ESA's websites.
We (or such service provider) automatically collect Internet protocol (IP) address information (e.g., browser type and date/time stamp) when you access the Services. It is possible that we (or such service provider) could be able to identify you by a combination of your IP address and other information.
3. INFORMATION WE COLLECT AND HOW WE USE IT
ESA collects two basic types of information: Personal Information (information that identifies you as an individual or relates to an identifiable individual or household) and Anonymous Information. The Personal Information ESA collects and how and for what purpose we use it will vary depending on the relationship we have with you (e.g., whether you are applying for a job or position with us or someone else) and the context it is provided.
a) ESA Job Applicants, Candidates, and Employees
We collect and process personal information required to operate a staffing agency, make employment decisions, fulfill human resource requirements, benefits administration, payroll administration, online portal management, and comply with local, state, and federal legal obligations and laws. ESA also utilizes personal information to maintain and update applicant, candidate, and employee accounts needed to provide employment opportunities.
b) Recruiting and Professional Placement Position Applicants
As part of ESA's recruiting division, ESA solicits, recruits, and evaluates applicants for professional placement positions for customers and clients that hire ESA to fill those positions directly at their companies.
c) Automatically Collected Anonymous Information
Anonymous information means information that does not identify an individual applicant. We may also use anonymous information to create aggregate information. Aggregate information means information about groups or categories of applicants and/or visitors to our website, which does not identify and cannot reasonably be used to identify an individual job applicant, employee, or website visitor. ESA uses anonymous data to maintain, operate, and improve our websites, including analyzing website traffic and running analytics. ESA may also use anonymous and aggregated information to analyze its business performance, including pay equity reports.
4. SHARING YOUR INFORMATION WITH OTHERS
ESA does not sell your personal information to third parties. Personal information is only shared with others to the extent necessary for human resources administration, to provide you with employment or secure your employment with another entity working with ESA, to service providers to provide you with employee benefits, to process any benefit and employment claims, screens, checks, tests, and evaluations to determine your employment eligibility and verification, to applications and websites that allow you to apply for ESA assignments and assist in scheduling (such as Calendly, TempWorks, Facebook and Indeed), and to websites and apps that provide you with perks and benefits relating to your employment. ESA will also disclose your personal information to the extent necessary to comply with legal obligations and laws. ESA may also disclose all categories of information when legally permitted or required by law, including to law enforcement or other government agencies, tax authorities, applicable regulators (or in response to requests from such parties), in the context of litigation or when we
otherwise believe in good faith that such disclosure is necessary or appropriate in connection with any activity that violates the law.
ESA may share anonymous data with its Internet and Technology Service Providers and Analytics Providers and Vendors to analyze our website traffic and improve its performance. ESA may also share anonymous and/or aggregated data to analyze its performance as a company, including pay equity reports and job satisfaction.
5. RETENTION OF PERSONAL INFORMATION
ESA processes and stores your personal information based on its business needs, to the extent needed to maintain our relationship with you, at your request to keep you informed on future possibilities until we no longer expect to need to use it for any legal and legitimate purpose and otherwise in accordance with all applicable laws.
6. DATA SECURITY
The security, integrity, and confidentiality of your personal information are critical. ESA has implemented technical and administrative security measures designed to protect personal information from unauthorized access, disclosure, use, and modification. ESA restricts and regulates access to Personal Information solely to protect confidentiality and maintain reasonable data security safeguards that comply with applicable laws and regulations to guard Personal Information. Unfortunately, despite such measures, no data transmission over the Internet and no database or other depository of information can be one hundred percent secure. As a result, while we will strive to protect your personal data, we cannot and do not guarantee or warrant the security of any of your personal information.

When accessing and visiting our website, data may be collected from you through the use of cookies, which are sent to your computer and saved automatically.
